Durant la pandémie, le numérique s’est révélé un outil précieux pour assurer une continuité de la vie professionnelle, de l’éducation, de la vie familiale et amicale, et assurer une appétence pour la vie culturelle disponible en ligne. La bataille contre le coronavirus grâce au numérique se joue également sur d’autres plans : des gouvernements, avec l’appui d’entreprises privées, développent de nouvelles politiques de surveillance de l’épidémie et des personnes infectées. Ces usages technologiques sont des gages d’efficacité mais également des facteurs (...) de risques pour les libertés des citoyens. (shrink)

Cet article se base sur des résultats d’enquête récents montrant que, chez des adolescents marocains âgés de dix à dix-huit ans, les manifestations de pensée critique dialogique se si-tuent majoritairement dans une « perspective épistémologique » appelée « relativisme » par un modèle développemental élaboré dans les quinze dernières années avec la méthode de la théorie ancrée. Pour comprendre ces résultats de recherche, qui contrastent avec ceux obte-nus auprès d’adolescents québécois et français appartenant aux mêmes groupes d’âge, nous décrivons, dans (...) un premier temps, le modèle développemental dans lequel ils prennent sens. Nous illustrons ensuite les manifestations de « perspective épistémologique relativiste » chez les adolescents marocains à l’aide d’extraits de verbatim. Les élèves ont tendance à se décen-trer de leur vécu personnel, à se représenter le point de vue d’autrui en général et à co-construire des points de vue convergents avec les pairs. Dans un deuxième temps, prenant appui sur une approche de la représentation sociale en tant que « scène », et sur la littérature touchant aux rôles des aînés dans les sociétés africaines, nous éclairons ces résultats de re-cherche par l’analyse d’une représentation sociale fréquemment mobilisée par les jeunes Ma-rocains interviewés : celle de la hiérarchie des âges et du devoir d’écoute envers les plus âgés. L’analyse de cette « scène » met en lumière des attitudes sociales inculquées aux adolescents en contexte culturel marocain, susceptibles de favoriser le développement d’une « perspective épistémologique relativiste » en matière de pensée critique dialogique. ABSTRACT: The concept of the “banality of evil,” put forward by Hannah Arendt to describe the psychological profile of the Nazi criminal in Eichmann in Jerusalem, is intimately tied to her reading of Plato. In Arendt’s examination of the question of evil, she found some support in Kant’s philosophy. However, the problem of guilt under Nazism ultimately goes back to an inability to think. The two-in-one, a concept which describes the activity of thinking, is based on Plato’s dialogues. An examination (...) of these philosophical sources contributes to the understanding of the possibilities and the limits of Arendt’s reflection on evil. RÉSUMÉ : Le concept de banalité du mal, proposé par Hannah Arendt pour décrire le profil psychologique du criminel nazi dans Eichmann in Jerusalem, est intimement lié à ses lectures de Platon. Pour aborder la question du mal, elle a découvert des appuis chez Kant, mais le problème de la culpabilité sous le régime nazi renvoie ultimement au défaut de penser. Le deux-en-un, concept qui décrit la pensée, a été défini sur la base de l’oeuvre platonicienne. L’examen de ces sources philosophiques permet de mieux comprendre les possibilités et les limites de la réflexion arendtienne sur le mal. (shrink)

Devant le constat du déclin toujours plus rapide de la diversité biologique et les limites des res- sources disponibles pour l’enrayer, il est nécessaire de déterminer quels moyens devraient être engagés dans sa protection. Pour ce faire, une méthode efficace serait d’évaluer les bénéfices tirés de la biodiversité afin d’estimer rationnellement les coûts légitimes de sa protection. L’évaluation économique, qui se présente d’emblée sur un mode quantitatif, serait alors un outil précieux. Dans ce texte, nous présentons différentes méthodes d’évaluation économique (...) de la biodiversité ainsi que certaines de leurs limites méthodologiques. Par la suite, nous montrons qu’en dépit de ses avantages pratiques, l’évaluation économique échoue à représenter l’ensemble des valeurs en jeu dans la protection de la biodiversité. Nous décrivons alors trois types de valeurs incommen- surables avec des bénéfices économiques : la valeur de legs, qui renvoie aux obligations de trans- mission du patrimoine naturel dont nous avons hérité ; la valeur d’existence, qui renvoie à la considération morale d’intérêts autres que ceux des êtres humains ; la valeur de transformation, qui renvoie à la capacité d’examiner et de critiquer nos préférences et inclinaisons afin d’inclure celles-ci dans une vision du monde rationnelle et cohérente. Pour conclure, nous plaidons en faveur de l’élaboration de méthodes de concertation et d’évaluation participatives et pluralistes permettant de rendre compte de la diversité et de l’hétérogénéité des valeurs de la biodiversité. Jusqu’à présent, les discussions au sein de la communauté universitaire et dans la littérature scientifique sur la conduite responsable en recherche (CRR), incluant l’intégrité scientifique et l’éthique de la recherche, ont principalement été menées par les chercheurs en sciences de la santé et en sciences fondamentales. Préoccupés, à juste titre, par des problèmes d’inconduite, leurs effets négatifs sur la rigueur scientifique et la confiance du public dans l’entreprise de la recherche, ces débats ont conduit à l’élaboration et à la mise (...) en œuvre de lignes directrices nationales et de politiques institutionnelles. Ces lignes directrices visent entre autres à promouvoir la CRR, notamment dans le but de prévenir ces inconduites. Cependant, pour garantir la pertinence et une application appropriée de ces normes à tous les domaines universitaires, il est nécessaire que les sciences humaines et sociales (SHS) contribuent plus directement à ces discussions. Un tel engagement devrait permettre d’exprimer les particularités disciplinaires et méthodologiques des SHS, dont certaines peuvent être très différentes des sciences appliquées et fondamentales. Cela permettrait également de s’assurer que la littérature sur la CRR ainsi que les politiques et les directives qui en découlent soient à la fois fondées sur des principes universellement généralisables, mais aussi appliquées avec nuance afin de refléter la diversité des pratiques disciplinaires. Dans ce chapitre, nous explorons trois grands domaines dans lesquels les SHS pourraient contribuer à façonner les discussions dans la littérature sur la CRR, tout en informant les chercheurs en SHS des meilleures pratiques en matière de CRR : l’autorat/paternité, la collaboration et l’autorégulation. L’éthique du care est confrontée à un problème qui a des allures de paradoxe : bien que sa politisation paraisse nécessaire, l’éthique du care ne semble pas pouvoir trouver en elle-même les ressources suffisantes à la formulation d’une théorie politique compréhensive. Il ne semble pas exister de théorie politique du care à part entière. Cet article examine la fécondité d’un rapprochement entre éthique du care et théorie néorépublicaine de la non-domination. Le résultat, non négligeable, serait de garantir des formes importantes (...) de protections aux activités de care, mais il cela n’empêcherait pas nécessairement les représentations négatives de ces activités, dont on peut supposer qu’elle est l’un des facteurs de la marginalisation et de la répartition inégale qui les affecte. Pour bloquer ces représentations dégradantes, il faudrait que le care soit discuté et défini dans l’espace public non seulement comme un lieu possible de la domination, mais comme un aspect fondamental et positif de la vie individuelle et collective. This essay intends contributing to clarify the intentions of its author, which remained debated until our time. More's book reflects a wide range of ancient and modern influences, while some particularities of his nararative go back to his quarrels with the intellectual and (...) theological milieus during his lifetime and to his friendship and intellectual relationship with Erasmus. La thématique de ce recueil collectif consacré à l' esprit démocratique est mise à l' enseigne du célèbre discours de Benjamin Constant comparant, au nom de l'idéal démocratique, la liberté politique des Anciens et celle qui se décline chez les Modernes. Comme le résume Jean-Marc Narbonne dans l'une de ses conférences : « Dans une démocratie directe [...] la nécessité du sacrifice des intérêts privés au profit du service à la collectivité peut faire craindre la disparition ou l' effacement des (...) aspirations personnelles ; dans une démocratie indirecte, plus encline à promouvoir la poursuite individuelle du bonheur et les bénéfices parti-culiers, c' est en revanche l'intérêt pour la chose publique en général qui risque de faire défaut [...] et qu'il s' agit de préserver. » Pour éviter ce double danger, à savoir l' embrigadement de l'individu d'un côté, la dislocation du lien social de l' autre, il faut combiner et maintenir fermement ensemble, comme le réclamait Constant lui-même, ces deux formes de liberté. Les contributions composant ce premier recueil des Cahiers Verbatim questionnent les liens objectifs entre la démocratie antique et nos démocraties modernes et l'influence, oui ou non déterminante, de celle-là sur ces dernières. Se situant au confluent du libéralisme politique rawlsien et de l’anthropologie néoaristotélicienne, l’approche des capabilités de Martha Nussbaum offre un cadre théorique permettant de répondre aux tensions multiculturelles. Cet article constitue une analyse détaillée de la réponse de Nussbaum à ces enjeux, qui prétend unir un pluralisme axiologique à un universalisme moral fort. Nous avancerons que la démarche entreprise par la philosophe porte une tension entre le libéralisme politique rawlsien et le cadre conceptuel apporté par la liste des capabilités. Cette (...) liste pose une difficulté par le déficit démocratique de ses fondements, n’intégrant pas suffisamment des normes d’inclusion et de représentation. Abstract. — This article argues that the reading of Plato has had an influence on the development of Hannah Arendt’s (1906-1975) political philosophy. It sketches H. Arendt’s profile of the “political Plato” and shows how Plato’s philosophy inspired H. Arendt’s philosophical project. It pays a special attention to the subject of totalitarianism. It shows that H. Arendt’s reading was greatly influenced by the ideological interpretations of Plato of the 1930’s and 1940’s, and by the work and the method of interpretation (...) developed by Martin Heidegger. Considerando el contexto bélico y el surgimiento de las vanguardias a inicios del siglo XX, fundamento en este trabajo las razones por las cuales la presencia del concepto de nivola, atribuida por Miguel de Unamuno para hacer referencia a la técnica literaria que emplea en su novela Niebla (1914), suscita una confrontación posible entre universos compuestos por elementos de la realidad y lo virtual. En ese sentido, será propicio explicar el procedimiento que origina esa colisión de planos establecidos. Le discours psychiatrique s’établit au XIXe siècle par un corps médical qui reproduit des relations de pouvoir : dans le cas de l’hystérie, le corps médical (majoritairement masculin) impose un discours de vérité sur un corps féminin qui est celui de la patiente. C’est la dimension genrée de ce phénomène que nous chercherons à clarifier en ce qui a trait aux relations de pouvoir, en avançant la thèse que les hystériques se dressent comme figure de résistance devant le pouvoir psychiatrique (...) – cette résistance étant rendue possible par la réappropriation d’une parole dérobée dans la production d’un discours de vérité. Pour ce faire, nous présenterons en premier lieu les démarches de Charcot, puis de Freud et Breuer dans les études sur l’hystérie. Nous emprunterons ensuite le cadre conceptuel foucaldien pour analyser les relations de pouvoir qui se trouvent au cœur de ces deux exemples, et nous tenterons finalement de montrer comment les hystériques peuvent être vues comme « militantes », à partir d’une perspective critique et féministe. We examine how Frege’s contrast between identity judgments of the forms “a=a” vs. “a=b” would fare in the special case where ‘a’ and ‘b’ are complex mental representations, and ‘a’ stands for an introspected ‘I’-thought. We first argue that the Fregean treatment of I-thoughts entails that they are what we call “one-shot thoughts”: they can only be thought once. This has the surprising consequence that no instance of the “a=a” form of judgment in this specific case comes out true, let (...) alone a priori true. This further reinforces Glezakos’s objections against the set-up of Frege’s puzzle, while also raising what we think is an acute problem for Fregeans, insofar as I-thought (and indexical thinking more generally), understood in their way, turns out to be incompatible with some basic features of rationality. In the last few decades, the historiographical categories rationalism and empiricism have been criticized for their limitations to explain the complex positions and the links held by the philosophers tradiotnally attached to them. This narrative was firstly conceived by Kantian German historians and began to become standard at the turn of the twentieh century. Nonetheless, nineteenth-century French historiography developed other narratives by which early modern philosophers were classified according to alternative criteria. In the first edition of Histoire comparée des systémes (...) de philosophie (1804), Joseph-Marie Degérando distinguishes three first-order early modern schools founded by Bacon, Descartes and Leibniz, respectively. Degérando introduces the empiricism and rationalism distinction as one among others, and not as the fundamental one. In addition, he separates empiricism from experimental philosophy. The last one, along with speculative philosophy, is said to conciliate senses and reason. As a result, this account offers philosophical groupings different from those constructed by the standard narrative. Furthermore, it draws on labels and classification criteria which were part of the early modern philosophical discourse. (shrink)

Marie Curie is the first scientist woman awarded the Nobel Prize in Physics (1903) and another in Chemistry (1911). Her life and her work summarize the tenacity, effort and passion for knowing aspects related to the reality of a new physical-chemical phenomenon: radioactivity. In this semblance, in addition to the scientific aspect, the human aspect that accompanies and sometimes overshadows the lives of great men is shown.

Resumen: Husserl propone una teoría sobre la intersubjetividad que parte de la conciencia trascendental como inserta en el mundo de la vida donde están los otros y donde la comunidad se construye bajo una estructura de esencias que garantiza la comunalidad. El mundo de la vida es dado y compartido por todas las conciencias intencionales y trascendentales, es condición para intuiciones empíricas y eidéticas, la epoché y las reducciones eidética y trascendental. Cada momento del método fenomenológico se basa en la (...) existencia de un mundo de la vida independiente de la subjetividad. En este mundo, hay objetos reales y, entre estos, los otros, reconocidos por analogía a través de la empatía. Desde una perspectiva metodológico-epistemológico, el yo es anterior al mundo y a los otros yos. El yo constituye, en sentido fenomenológico, la realidad. La conciencia es el lugar de evidenciación de la realidad. No obstante, en la perspectiva ontológica, es lo contrario. El mundo de la vida es anterior a la conciencia individual. El mundo de la vida está ahí, disponible, existente, independiente del sujeto, funcionando con su propio orden, con sus leyes y reglas. Es el yo el que esta insertado en el mundo de la vida y que se esfuerza por desvendarlo. La realidad se impone y el yo es, sobre todo, miembro de una comunidad de otros yos. Aun así, ¿cómo compartir las experiencias? Las vivencias pueden ser diferentes, pero hay un límite en las variaciones, un límite dado por la esencia del objeto vivido y por las leyes que rigen las relaciones de tal objeto. Así, la constitución del mundo y de sus objetos está permanentemente en progreso. Es posible donarles nuevos sentidos, en los límites de su esencia. Para Husserl, la constitución comunal del mundo es la condición de posibilidad para la existencia de sujetos separados unos de los otros, y este entendimiento recíproco solo es posible a través de la constitución trascendental de la objetividad. Así, no hay una separación entre la intersubjetividad y la constitución del mundo, es la comunidad de yos la que dona sentidos a las objetividades. En el mundo de la vida con los otros en comunidad. -/- Abstract: Husserl proposes a theory on intersubjectivity that starts from transcendental consciousness as inserted in the lifeworld where the others and where the community are built under a structure of essences that guarantees communality. The lifeworld is given and shared by all intentional and transcendental consciousnesses, it is a condition for empirical and eidetic intuitions, the epoché and the eidetic and transcendental reductions. Every moment of the phenomenological method is based on the existence of a lifeworld independent of subjectivity. In this world, there are real objects and, among these, the others, recognized by analogy through empathy. From a methodologicalepistemological perspective, the self is prior to the world and the other selves. The self constitutes, in a phenomenological sense, reality. Consciousness is the locus of evidence of reality. However, from the ontological perspective, it is the opposite. The lifeworld is prior to individual consciousness. The lifeworld is there, available, existing, independent of subjectivity, functioning with its own order, with its laws and rules. It is the self that is inserted in the lifeworld and that strives to unveil it. Reality prevails and the self is, above all, a member of a community of other selves. Even so, how to share the experiences? The experiences can be different, but there is a limit in variations, a limit given by the essence of the lived object and by the laws that govern the relation of the object. Thus, the constitution of the world and its objects is permanently in progress. It is possible to give them new meanings, within the limits of their essence. For Husserl, the communal constitution of the world is the condition of possibility for the existence of subjects separated from each other, and this reciprocal understanding is only possible through the transcendental constitution of objectivity. therefore, there is no separation between intersubjectivity and the constitution of the world, it is the community of selves that gives meaning to objectivities. La multiplicación de las dimensiones de la realidad acarrea consigo una serie de posibilidades que han permitido reproducir dinámicas humanas del mundo físico en ámbitos no contemplados con anterioridad. La realidad virtual se configura como el nivel de más significación actual para replantearse lo que es el ser humano, lo cual hace que esta funja como una potencialidad ontológica sin parangón. Sin embargo, su amplitud trae consigo una amplia serie de dificultades, que cuestionan las bases ontológicas de la constitución del (...) ser humano y la manera cómo sea dado a lo largo de la historia la interacción entre los individuos. Estas potencialidades recrean amenazas que patentizan la fragilidad del sujeto. Es por ello necesario reflexionar sobre estas dificultades, analizando las características que la virtualidad recrea y cómo funciona en la construcción de la identidad personal y la autoconcepción del individuo. Aceptar que lo virtual constituye también una dimensión de la realidad humana que extiende sus características y que influye severamente en la transformación de su ontología permitirá descubrir nuevos caminos de reflexión y análisis que alejen las amenazas que buscan socavar lo humano y, ante su fragilidad, se presenten como herramientas para continuar trabajando en la igualdad y la dignidad de cada individuo. La atención relativamente escasa que los estudiosos del filósofo y científico norteamericano Charles S. Peirce (1839-1914) han prestado a lo largo de los años a la dimensión religiosa de su pensamiento siempre me ha resultado un tanto sorprendente. Desde mis primeras lecturas de Peirce me impresionó profundamente la ubicuidad de las referencias religiosas en sus escritos, especialmente en los años de madurez. En mis encuentros con reconocidos estudiosos peirceanos solía preguntarles acerca de Dios y la religión en Peirce, y la (...) respuesta que recibí casi siempre era que efectivamente había una gran cantidad de cuestiones religiosas en su obra, pero que no estaban interesados en ello. Dentro del espacio disponible, mi exposición está organizada en cuatro secciones: 1) Una presentación del artículo de 1908; 2) La noción de realidad; 3) ¿Cuál es realmente el Argumento Olvidado?, y 4) Una discusión de su alcance destacando el poder de la abducción. Citaré a algunos de los comentaristas más relevantes y aportaré un texto del propio Peirce interpretando su artículo que no he visto hasta ahora citado: se trata de la carta de Peirce del 28 de noviembre de 1908 (L 212) en la que explica a su amiga Mary Huntington el artículo publicado en el Hibbert Journal poco tiempo antes. A reflection on the philosophical traditions at the Autonomous University of Nuevo Leon and in the city of Monterrey.

A presente investigação tem por objetivo responder à questão título considerando os argumentos apresentados, de um lado, pelos desenvolvimentistas e, de outro, pelos ambientalistas. Entendemos que os argumentos apresentados refletem um conflito de valores mais profundo que, se abordado por uma metodologia de solução de conflitos adequada, pode contribuir para elucidação da questão. A metodologia proposta é o personalismo ético de Scheler. A hierarquia de valores a ser aplicada na solução de conflitos traz (i) o valor pessoa como o mais (...) elevado, seguido dos (ii) valores espirituais, como a justiça, (iii) os vitais, como o bem estar e o útil, e (iv) os sensíveis. Através das ações de preferir e postergar, é possível encontrar pontos de equilíbrio numa permanente atitude crítica. O objetivo é contribuir para que as ações ocorram com a devida diligência para com os direitos humanos. A hipótese inicial é que, identificando os valores em conflito e aplicando a metodologia descrita, a solução de conflitos neste caso concreto permite pensar numa transição energética que concilie o desenvolvimento e o meio ambiente. Compreendemos que ambos têm como fim proteger o valor pessoa. Portanto, o que está em conflito de fato, sem com isso assumir uma postura ingênua, são os valores espirituais e vitais de cada uma das partes. Neste sentido, defendemos que, diante da inevitável demanda por energia da sociedade contemporânea e do alto custo da transição energética, é preciso conciliar o desenvolvimento com o meio ambiente a partir de uma programada transição energética financiada pela exploração do petróleo e gás, mas com metas definidas comprometidas com a neutralidade da emissão de GEE em 2050. Para tanto, é necessário regulamentação, monitoramento e fiscalização por parte do Estado e do governo federal com a finalidade de garantir a substituição dos combustíveis fósseis por fontes energéticas limpas. Este texto analiza las concepciones que J. S. Mill y K. Marx defienden sobre la libertad, con el fin de establecer si entre ellas hay puntos de convergencia, a pesar de las diferentes motivaciones que las impulsan. En este sentido, la tesis que se propone es que ambos pensadores coinciden en la defensa que realizan de la libertad, dado que le otorgan un papel destacado a la autodeterminación, el libre desarrollo de la individualidad y a la existencia de condiciones materiales (...) para su concreción. Así las cosas, las distancias que las separan no constituyen ningún óbice al momento de abogar por lo que consideran como el valor fundamental del ser humano. (shrink)

This chapter elaborates and develops the thesis originally put forward by Mary Morgan (2005) that some mathematical models may surprise us, but that none of them can completely confound us, i.e. let us unable to produce an ex post theoretical understanding of the outcome of the model calculations. This chapter intends to object and demonstrate that what is certainly true of classical mathematical models is however not true of pluri-formalized simulations with multiple axiomatic bases. This chapter thus proposes to (...) show that - and why - some of these computational simulations that are now booming in the sciences not only surprise us but also confound us. To do so, it shows too that it is needed to elaborate and articulate with some new precision the concept of weak emergence initially due, for its part, to Mark A. Bedau (1997). (shrink)

Aristotle’s influence on D’Arcy Thompson was praised by Thompson himself and has been recognized by others in various respects, including the aesthetic and normative dimensions of biology, and the multicausal explanation of living forms. This article focuses on the relatedness of organic forms, one of the core problems addressed by both Aristotle’s History of Animals (HA), and the renowned chapter of Thompson’s On Growth and Form (G&F), “On the Theory of Transformations, or the Comparison of Related Forms.” We contend that, (...) far from being an incidental inspiration stemming from Thompson’s classicist background, his translation of HA played a pivotal role in developing his theory of transformations. Furthermore, we argue that Thompson’s interpretation of the Aristotelian method of comparison challenges the prevailing view of Aristotle as the founder of “typological essentialism,” and is a key episode in the revision of this narrative. Thompson understood that the method Aristotle used in HA to compare animal forms is better comprehended as a “method of transformations,” leading to a morphological arrangement of animal diversity, as opposed to a taxonomical classification. Finally, we examine how this approach to the relatedness of forms lay the foundation for a causal understanding of parts and their interconnections. Although Aristotle and Thompson emphasized distinct types of causes, we contend that they both differ in a fundamental sense from the one introduced by Darwin’s theory of natural selection, which was formulated as a solution to the species problem rather than the form problem. We conclude that Thompson’s interpretation of Aristotle’s approach to form comparison has not only impacted contemporary scholarship on Aristotle’s biology, but revitalized a perspective that has regained significance due to the resurgence of the problem of form in evo-devo. Philosophy in the City (or PinC, as it came to be known) is an outreach programme led by student volunteers from the University of Sheffield's Department of Philosophy. It aims to bring philosophy out of the university and into the wider urban community, stimulating young and older minds through events and activities organised with local partners, including schools, charities, and a homeless shelter. Since its inception in 2006, the project has seen hundreds of student volunteers from the university engage in (...) philosophical conversations with thousands of local residents from a wide variety of backgrounds. Sixteen years on, what can we learn from the achievements and shortfalls of this initiative? The present paper is not a systematic review of the project’s history, but a retrospective dialogue between the two authors who both participated in its foundation and its early development: Alexis Artaud de la Ferrière was the project’s first President and Joshua Forstenzer its third. In the course of this dialogue, they revisit the initial motivations and ambitions undergirding the project, discuss the obstacles faced throughout their respective tenures of leadership, and analyse the evolving mission of the project against the backdrop of historic changes in English higher education which occurred during this period. Resumen Este trabajo consiste en un análisis histórico de textos que proceden de un expediente archivístico de Cartagena de Indias entre 1715 y 1717. Los autos son textos administrativos que poseen diversas funciones en las relaciones institucionales entre metrópoli y colonias, tal como la de “emitir opinión”. En la tipología textual indiana, esta función se denomina consulta o parecer, y se caracteriza por el uso de un predicado de tipo doxástico. Para el análisis hemos adoptado las perspectivas teóricas del análisis (...) histórico del discurso y de la sociopragmática histórica. El estudio se completa con un análisis cuantitativo que permite resaltar cuáles son los rasgos lingüísticos a los que se vincula la intensificación y la atenuación en el subtipo debate dentro del registro legal en el español de la Cartagena del siglo XVIII. La conclusión sugiere que los recursos lingüísticos encontrados aumenta la intención persuasiva de la argumentación característica de los autos cartagineses. (shrink)

En el presente trabajo se parte de que la innovación requiere transmisión de información. En la actualidad, el contenido de la transmisión de información se halla sometido a una regulación legal, habitualmente la propiedad intelectual, donde los agentes intervinientes y su requisito de sistema de permisos dificultan la transmisión libre. Para solucionar esta problemática, se están promoviendo dos tipos de soluciones: el primero mediante código legal y el segundo mediante código informático. The traditional use of conventional media by businesses for audience targeting has shifted with the rise of influencer marketing, notably on platforms like TikTok, posing challenges in content adaptation and technological adaptation. Albert Bandura's Social Cognitive Theory examines factors shaping purchasing behavior, particularly relevant for young professionals. A quantitative correlational study focused on young professionals engaging with TikTok and influenced by Filipino TikTok creators, revealing education level as a key determinant of purchasing behavior. Extended TikTok engagement positively correlates with increased (...) purchasing likelihood. Filipino TikTok influencers significantly impact young professionals' purchasing decisions, emphasizing the need for tailored marketing strategies targeting this demographic. The idea of the life-world: Life-world is a concept present in various texts about Husserl’s phenomenology. Some interpreters consider it a late and inconsistent concept present in The Crisis of European Sciences and Transcendental Phenomenology. In this paper, I argue that the idea of the life-world had already been thought in Husserl’s early texts such as Ideas II. This idea was firstly named as surrounding world, then world of experience, and finally life-world. However, despite the different nomenclature, the essence of (...) the life-world remains the same throughout his work. The life-world is a priori, transcendent, and co-given. Abstract: In this article I intend to highlight how the relationship between the psychic ego (seelischen Ich) and the spiritual ego (geistige Ich) is fundamental to the understanding of intersubjectivity and the lifeworld (Lebenswelt). In Ideas II, Husserl explains how, from the ego, natural, psychic and spiritual objectivities are constituted. These three strata of objectivity are known, first, in the theoretical attitude and, second, in the spiritual attitude. In this process, the ego becomes explicit. In the theoretical attitude, the constitution (...) of nature takes place, for which the body (Körper/Leib) is fundamental. This is followed by the constitution of objects of psychic nature, human or animal (tierisch), including self-perception. In assuming the spiritual attitude, the other is perceived (Urpräsenz) initially as a body together with things, and alongside this perception there is an apprehension (Appräsenz) of co-given horizons. There is an identity between the body of others and mine; it is the moment of empathy (Einfühlung). The scientific world constituted in the theoretical attitude is a reduction of the surrounding world (Umwelt) – the lifeworld (Lebenswelt). This lifeworld is the world of spiritual attitude and precedes any comprehension or explanation of the world. După sfârşitul celei de a doua mari conflagraţii mondiale, Europa se afla în ruină şi dezastru economico-social. Ajutorul dat de Statele Unite ale Americii în reconstrucţia statelor europene a fost vital pentru supravieţuirea Occidentului european. În anul 1948, cinci state (Franţa, Marea Britanie, Belgia, Ţările de Jos şi Luxemburg) semnează Tratatul de Cooperare Culturală, Socială, Economică şi Apărare Colectivă, pe scurt Tratatul de la Bruxelles . După numirea generalului Dwight Eisenhower în funcţia de comandant suprem aliat în Europa, acest tratat (...) va deveni parte a documentelor NATO. Nevoia de apărare împotriva ameninţării sovietice se face şi mai vizibilă în propunerea ministrului de externe francez Réne Pléven. Planul Pléven, propus în anul 1952, viza constituirea unei Comunităţii Europene a Apărării, dar şi a unei Comunităţi Politice Europene. Planul nu a fost votat de către Adunare Franceză în anul 1954. Eşecul acestei comunităţi se datorează lipsei de viziune a liderilor europeni. O altă piedică în adoptarea acestui plan a fost teama statelor naţionale de posibila federalizare a Europei. (shrink)

In this paper, I discuss the possibility of reading the description of promise presented by Reinach in The Apriori Foundations of the Civil Law under the light of Husserl’s Ideas I. In order to present my argument, first, I briefly present the phenomenological method proposed by Husserl in Ideas I highlighting eidetic reduction. Second, I present the Reinachian description of social acts emphasizing the act of promising. Third, and finally, I try to demonstrate that the Reinachian description of the social (...) act of promising is the description of a universal and necessary relation, a synthetic and a priori statement and corresponds to the idea of promise. Resumo: neste artigo pretendo estender a evidenciação do encobrimento do mundo da vida formulada por Husserl ao uso das tecnologias disruptivas da 4ª Revolução Industrial, mais precisamente o uso da inteligência artificial (IA) nas plataformas sociais. Primeiro, apresento o conceito de mundo da vida que se mantém consistente ao longo das obras de Husserl; em seguida, apresento seu encobrimento derivado da matematização da natureza e do rompimento com o telos, o que originou a crise da humanidade europeia. Segundo, mais camadas (...) de encobrimento do mundo da vida vão se sobrepondo com a 3ª e 4ª RIs. Em mais detalhe, o encobrimento e o afastamento do mundo da vida provocado pelo uso da IA e seus efeitos negativos, individual e coletivamente. Terceiro, a proposta Husserliana de retorno ao mundo da vida através de uma epoché radical. Concluo que a solução proposta por Husserl para a crise ainda é atual e urgente. Abstract: in this paper I intend to extend the disclosure of the cover-up of the lifeworld formulated by Husserl to the use of disruptive technologies of the 4th Industrial Revolution, more precisely the use of artificial intelligence on social platforms. First, I present the concept of lifeworld that remains consistent throughout Husserl's works; then, I present its cover-up derived from the mathematization of nature and the break with the telos, which originated the crisis of european humanity. Second, more layers of cover-up of the lifeworld overlap with the 3rd and 4th IRs. In more detail, the cover-up and detachment from the lifeworld caused by the use of AI and its negative effects, individually and collectively. Third, the Husserlian proposal of return to the lifeworld through a radical epoché. I conclude that the solution proposed by Husserl to the crisis is still actual and urgent. (shrink)

Viktor Frankl’s Logotherapy is based on Max Scheler’s theory of values and anthropology. Frankl builds his psychological thinking based on critical concepts of Schelerian thinking such as (i) value and goods, (ii) will and feelings, (iii) the hierarchy of values, and (iv) the idea of person. It is with them that he develops his original theses of (i) the spiritual motivation of human action, (ii) the search for meaning and (iii) the spiritual unconscious. In doing so, he offered not only (...) a psychotherapy of values, but also a new theory of positive human motivation, not conceived as a result of deficiency or need, but as a result of the free spirit toward objective values. The human search for meaning in life can only be successful by living and realizing superior values, in the hierarchical sense proposed by Scheler. (shrink)

While the notion of chance has been central in discussions over the probabilistic nature of natural selection and genetic drift, its role in the production of variants on which populational sampling takes place has received much less philosophical attention. This article discusses the concept of chance in evolution in the light of contemporary work in evo-devo. We distinguish different levels at which randomness and chance can be defined in this context, and argue that recent research on variability and evolvability demands (...) a causal understanding of variational probabilities under which development acquires a creative, rather than a constraining role in evolution. We then provide a propensity interpretation of variational probabilities that solves a conceptual confusion between causal properties, variational probabilities and extant variation present in the literature, and explore some metaphysical consequences that follow from our interpretation, specifically with regards to the nature of developmental types. Resumo: A Logoterapia proposta por Viktor Frankl está fundamentada na teoria dos valores e antropologia de Max Scheler. Frankl constrói seu pensamento psicológico baseado em conceitos-chave do pensamento scheleriano como (i) o valor e os bens, (ii) o querer e os sentimentos, (iii) a hierarquia de valores e (iv) a ideia de pessoa. É com eles que desenvolve suas teses originais da (i) motivação espiritual da ação humana, (ii) busca de sentido e (iii) inconsciente espiritual. Ao fazê-lo, ofereceu não só (...) uma psicoterapia dos valores, mas também uma nova teoria da motivação humana positiva, não concebida como fruto de deficiência ou necessidade, mas do espírito livre direcionado a valores objetivos. A busca humana por sentido na vida só é possível ser bem-sucedida com a vivência e realização de valores superiores, no sentido hierárquico proposto por Scheler. (shrink)

Neste artigo pretendo evidenciar como a relação entre sujeito anímico e sujeito espiritual é fundamental para a compreensão da intersubjetividade e do mundo da vida (Lebenswelt). Em Ideias II, Husserl explica como, a partir do eu, sujeito e objeto são constituídos no mundo: natureza, alma e espírito. Estes três estratos do sendo são conhecidos a partir da atitude teorética e da atitude espiritual e, no processo, se dá a explicitação do eu. Numa atitude teorética, temos constituição da natureza, para o (...) que o corpo (Körper/Leib) é fundamental. Em seguida, a constituição de objetos de natureza anímica, humana ou animal, incluindo a autopercepção. Assumindo a atitude espiritual, o outro é percebido (Urpräsenz), inicialmente, como corpo junto às coisas e, ao lado desta percepção, há uma apercepção (Appräsenz) dos horizontes co-dados. Há uma identidade entre o corpo alheio e o meu, é o momento da empatia (Einfühlung). O mundo constituído a partir de uma atitude naturalista ou teórica é uma redução do mundo circundante (Umwelt), mas o mundo cotidiano da atitude personalista ou espiritual lhe antecede, o mundo vital (Lebenswelt). This paper deals with Veronica Rodriguez-Blanco’s answer to the paradox of the normativity of law: How can autonomous self-legislating persons act, without compromising their autonomy and their will, following legal rules? Regarding Rodriguez-Blanco’s answer, I offer two main critiques. The first one is based on Rodriguez-Blanco’s comments to David Enoch’s paper in which I argue against the idea that a descriptive theoretical account of law can, and should, give an answer to general problems of normativity due to the fact that (...) a theoretical approach that engages in questions about the normativity of law cannot be purely descriptive, therefore against Rodriguez-Blanco I conclude that Enoch’s answer is the only response a descriptive account is able to offer. The second criticism focuses on Rodriguez-Blanco’s response to the paradox and argues that her solution is not, in fact, a descriptive one, but one that relies on strong normative premises, which as it turns out defend a perfectionist perspective towards the law.Resumen:Este trabajo analiza la respuesta que Veronica Rodriguez-Blanco propone para resolver la paradoja de la normatividad del derecho: ¿Cómo es posible que una persona autónoma actúe siguiendo los mandatos de normas jurídicas sin comprometer su autonomía ni su voluntad? El autor ofrece dos críticas a la respuesta de Rodriguez-Blanco. La primera de ellas está basada en los comentarios que Rodriguez-Blanco ha hecho sobre la propuesta de David Enoch. En este punto, el autor argumenta en contra de la idea según la cual una perspectiva descriptiva del derecho puede, y debe, tratar de responder a los problemas generales de la normatividad del derecho. De acuerdo con el autor, una perspectiva que pretenda dar respuesta a los problemas de la normatividad del derecho no puede ser una perspectiva puramente descriptiva. En este sentido, el autor sostiene que la respuesta que ofrece Enoch es la única respuesta que una perspectiva descriptiva del derecho puede dar. La segunda crítica está dirigida a la respuesta que Rodriguez-Blanco da sobre la paradoja de la normatividad. En este segundo punto el autor argumenta que la perspectiva de Rodriguez-Blanco no es una perspectiva descriptiva como ella presume, sino que adopta una perspectiva normativa la cual, además, está comprometida con una idea perfeccionista del derecho. Max Scheler apresentou sua formulação sobre o problema do livre arbítrio no opúsculo Phänomenologie und Metaphysik der Freiheit, de 1912- 1914, publicado em Gesammelte Werke, Band X. No presente capítulo, esta compreensão é apresentada de maneira resumida e, em seguida, apreciada à luz do debate contemporâneo entre o compatibilismo e o incompatibilismo. Ao fim, se pretende justificar a hipótese de que a posição scheleriana neste debate seria em favor do incompatibilismo libertarianista.

Open science (OS) is considered the new paradigm for science and knowledge dissemination. OS fosters cooperative work and new ways of distributing knowledge by promoting effective data sharing (as early and broadly as possible) and a dynamic exchange of research outcomes, not only publications. On the other hand, intellectual property (IP) legislation seeks to balance the moral and economic rights of creators and inventors with the wider interests and needs of society. Managing knowledge outcomes in a new open research and (...) innovation ecosystem is challenging and should become part of the EU’s IP strategy, underpinning EU policies with the new open science–open innovation paradigm. Preface to the thematic volume Metatheoretical Structuralism: Some Recent Developments and Applications.

In this paper, I present the difficulty in the phenomenology of explaining the constitution of objectivities in consciousness. In the context of phenomenological reduction, constitution has to be understood as unveiling the universal and necessary essences. Recognized by Husserl in Ideas I and named as functional problems, the constitution of objectivities refers at first to individual consciousness, and then to an intersubjective one. In Ideas II, the phenomenologist explains how the constitution of nature, psyche, and spirit occurs. This process begins (...) by assuming three premises: the ontological realism, the regularity of nature, and the transcendental idealism. In this process, the ego, apart from constituting objects (the body, the psyche, and the others), constitutes itself. The objects of material reality are constituted through aesthetic synthesis which unifies singularities and contextualizes the lived experience. The body, as a perceptive organ, perceives the exterior, and the location of the sensory stimulus is the soul. The soul is a real and transcendent object, which is linked to physical things that are constituted in a solipsistic way or intersubjectively. Empathy allows the subject to recognize the consciousness of the alter ego as capable of spontaneous movements and actions, a co-presence sharing the same horizons. Thus, through the theoretical attitude, the physical world is perceived, and through the spiritual attitude the spiritual world is perceived, a living world shared by free intelligent beings. For this, intersubjectivity fulfills a fundamental role, because only in the relationship with the other does the identity of the objects, of the other, and of the self become evident. (shrink)

The aim of this investigation is to discuss the concept of realism and idealism applied to Husserlian phenomenology, distinguishing the ontological and the epistemological dimensions. Therefore, I propose questions that will help to mark this distinction. The answers will be given with reference to Husserl's texts and commentators.
